By creating a FinBaby account or using the FinBaby app in any way, you agree to these Terms of Use and our Privacy Policy. If you don't agree, please don't use FinBaby.
FinBaby is intended for use by adults (18 years or older) to track information about their own children, with the knowledge and involvement of the child's other parents/guardians where applicable. FinBaby is not directed at children, and children should not create their own FinBaby accounts.
FinBaby is currently provided free of charge. We may introduce optional paid features in the future; if we do, we will communicate this clearly in advance and will not silently start charging for features you already rely on. FinBaby is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or available at all times.
FinBaby's core feature is shared, equal access for every caregiver you invite into your family's care circle via your invite code. You are responsible for:
You agree not to: use FinBaby for any unlawful purpose; attempt to gain unauthorized access to another family's data; reverse-engineer, scrape, or attack the service; upload content that is unlawful, abusive, or infringes another person's rights; or use the service to store information about a child other than your own without appropriate authority (e.g., as a legal guardian or authorized caregiver).
FinBaby, its branding, design, original written content (including the development guides), and underlying software are owned by FinSmart Holdings. You retain ownership of the data you log (your family's records); you grant us only the limited right to store and display it back to you and your invited caregivers in order to provide the service.
To the fullest extent permitted by law, FinSmart Holdings and FinBaby will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of, or inability to use, the service — including any decision made in reliance on tracked data, guide content, or growth charts. Nothing in these terms limits liability that cannot lawfully be limited (for example, liability for gross negligence or willful misconduct, where applicable under your local law).
You agree to indemnify and hold harmless FinSmart Holdings from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the service, your violation of these terms, or content you log that infringes the rights of a third party.
You may stop using FinBaby and request deletion of your account and family data at any time by contacting admin@finsmartsa.co.za. We may suspend or terminate access for accounts that violate these terms.
We may update these terms as FinBaby evolves. Continued use of the app after an update constitutes acceptance of the revised terms. Material changes will be flagged in-app where practical.
These terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you may have under the law of your own country of residence.
